Terms and Conditions

  1. Object and Scope

Gigaoptik, through its E-shop, sells and distributes optical products, mainly: prescription glasses, sunglasses, and contact lenses. It does not provide vision prescription services.

All products offered on the E-shop are available throughout the territory of Spain, except for Ceuta, Melilla, and the Canary Islands.

Gigaoptik reserves the right to make changes and updates to products, prices, promotions, and other conditions listed on the E-shop.

If any typographical error is detected, it will be corrected, and purchases affected by such an error may be cancelled by either party at no cost, provided the existence of the error is justified.

Purchasing through this E-shop implies acceptance of the General Terms and Conditions, meaning the User has understood the contents of this document and is responsible for the accuracy of the information provided during the online purchase process.

  1. Specific Purchase Conditions for Prescription Glasses, including Prescription Sunglasses

By placing an order for prescription glasses on our E-shop, you confirm that within the last 12 months, a licensed optician, optometrist, or ophthalmologist has performed a tolerated and exception-free prescription adaptation.

If, on the contrary, you are considering using any prescription product for the first time, you must visit a qualified healthcare professional to perform the adaptation of your first prescription glasses or lenses.

Once this has been done, we can sell you additional or replacement glasses with the indicated prescription.

In this regard, the user acknowledges understanding that:

  1. Gigaoptik E-shop will send replacement glasses based on the information the customer has provided during the prescription configuration process.
  2. You are responsible for the accuracy and truthfulness of the prescription data submitted for purchasing replacement prescription glasses.

Customised products based on lens prescription cannot be returned or refunded, except for the reasons specified in the returns section of these terms.

  1. Prices and Accepted Payment Methods

Product prices are listed in Euros on the product detail page and include VAT, but exclude shipping, handling, packaging, insurance, or any additional service. These costs will be added to the total amount in the shopping cart.

We accept the following payment methods: Credit/Debit Cards and PayPal. You may also pay with Google Pay or Apple Pay.

After payment has been completed, the User will receive an order confirmation email including a summary of purchased items, selected shipping method, and delivery address.

Gigaoptik may offer discount codes to its Users, which are subject to the specific conditions outlined for each code. Only one code can be used per order, and codes may not be compatible with certain promotions or collections.

  1. Customer Account

After registering on the E-shop, the buyer can access their customer account. From this account, they can place orders. Orders can also be made without registration.

When registering or placing orders, the Buyer must provide accurate and truthful information. The Buyer must update the account information whenever it changes. The Seller will rely on the accuracy of the information provided during registration and ordering.

Account access is protected by a username and password. The Buyer must maintain the confidentiality of this information. The Seller is not responsible for misuse of the account by third parties.

The Buyer is not allowed to permit third parties to use their account.

The Seller may cancel the account, especially if unused for over 2 years or if the Buyer violates these General Conditions or the Purchase Agreement.

The Buyer acknowledges that the user account may not be continuously available, particularly due to necessary maintenance of the Seller's or third-party hardware/software.

  1. Shipping and Delivery

Gigaoptik s. r. o. uses PPL/DHL Partner as its shipping provider. Shipping is charged at a flat rate of €4.

Delivery times depend on the type and characteristics of the product.

In case of incorrect or missing shipping details, Gigaoptik is not responsible for the inconvenience caused, and reshipping costs will be charged to the customer.

Responsibility for the products remains with Gigaoptik until you receive the shipment.

Ownership is transferred upon full payment of the purchase price, including delivery costs, but not before the buyer takes possession of the goods. Responsibility for accidental destruction, damage, or loss passes to the buyer upon receipt or upon their failure to accept the delivery.

The Seller will issue a tax document - invoice to the Buyer.

In case of force majeure preventing delivery within the estimated time, Gigaoptik will inform you of the new expected delivery date as soon as possible.

Upon receipt, you must verify that the order matches the quantity and type of product requested. Any discrepancies must be addressed as outlined in the Returns section.

Upon receiving the goods, the buyer must inspect the package. Any signs of damage must be immediately reported to the courier. If the package shows signs of tampering, the buyer must not accept the delivery.

Shipping costs will be communicated during order confirmation. Acceptance of the General Terms and Conditions implies acceptance of shipping fees.

  1. Legal Warranty and After-Sales Service

All products sold by Gigaoptik through the E-shop come with a two-year warranty from the date of delivery.

If you notice any defects not caused by accidental damage or improper use, we will repair, replace, or discount the product at no cost. Please contact Customer Support for assistance (Email: info@gigaoptik.es).

  1. Order Cancellation

Custom-made products are excluded from the right of cancellation and will be informed as such.

If cancelled, Gigaoptik will refund the amount paid by the User. Shipping and insurance costs will be borne by the User.

After the stated cancellation period has passed, cancellation is no longer possible, and the return policy must be followed.

Cancellations must be requested by email at info@gigaoptik.es, including the reason and bank account details for the refund: bank name, account holder name, and account number.

Gigaoptik reserves the right to cancel orders if the requested product is out of stock or due to external circumstances beyond company control. No liability will be accepted by Gigaoptik or its staff.

Refunds will be processed within 14 working days after receiving the cancellation notice.

Returns

8.1 Returns for Damaged, Defective or Incorrect Products

If products arrive damaged, defective, or incorrect, Gigaoptik will replace them free of charge, provided availability. If replacement is not possible, the product price and shipping costs will be refunded.

To return a product, contact Customer Service within 3 business days of receiving your order. After this period, returns for these reasons cannot be accepted.

8.2 Right of Withdrawal

You have the right to withdraw from this contract within 14 calendar days without providing a reason.

The withdrawal period expires 14 days from the day you or a third party, other than the carrier, physically received the last item.

To exercise your right, notify us at GIGAOPTIK s. r. o., Canarias 10, F 3 BL 2 PTA 2, Gran Alacant 03130 , +34 643 07 94 63, info@gigaoptik.es, with a clear statement (e.g. by post, fax, or email). You may use the withdrawal form provided, but it is not mandatory.

Alternatively, you may complete and submit the withdrawal form or any clear statement via your private E-shop area. We will acknowledge receipt without delay.

To meet the withdrawal deadline, you must send your communication before the 14-day period expires.

Consequences of Withdrawal

If you withdraw, we will refund all payments received from you, including standard delivery charges (excluding any extra costs for express delivery), without undue delay and within 14 calendar days of receiving notice of withdrawal. Refunds will be made using the same payment method unless you specify otherwise. No fees will apply.

We may withhold the refund until we receive the goods or until you provide proof of return, whichever comes first.

You must return the goods without undue delay, no later than 14 days from notifying us of the withdrawal. This deadline is met if you send back the goods before it expires.

You bear the direct cost of returning the goods.

You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

8.3 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the consumer’s specifications or clearly personalised.
  • Sealed goods not suitable for return for health or hygiene reasons, once unsealed after delivery.

These General Conditions and the Claims Procedure are effective as of 05.05.2024.
